प्रिय अखिलेश जी,

नमस्कार। आरंभ में, मैं आपको उत्तर प्रदेश का सबसे युवा मुख्य मंत्री, और शायद पूरे देश में सबसे युवा मुख्य मंत्री बनने पर बधाई देता हूँ। पूरे राष्ट्र की निगाह आप पर टिकी हुई है। हमें पूरी उम्मीद है कि आपके शासन में उत्तर प्रदेश की सरकार प्रगतिशील और गतिशील रहेगी जो आपके नवयुवा व्यक्तित्व के अनुरूप है।

मैं विनम्रतापूर्वक अपना परिचय देना चाहता हूँ। मैं मुम्बई स्थित टाटा मैमोरियल अस्पताल में जो कैंसर के निदान एवं उपचार के लिए एक प्रतिष्ठित अस्पताल है, एक कंसल्टेंट सर्जन हूँ। हरेक मंगलवार और बृहस्पतिवार को मैं दाखिला के लिए प्रतीक्षारत दर्जनों नए मरीजों की जांच करता हूँ। मैं उनके बीच यह देखकर बहुत दुखी हूँ कि एक बहुत बड़ी संख्या में लोग तम्बाकू के विभिन्न रूपों के प्रति अपनी लत के कारण मुँह या गले के कैंसर से पीड़ित हुए हैं।

ये मरीज पूरे भारत से विभिन्न राज्यों से आते हैं। लेकिन मैं अत्यंत दुख के साथ आपको सूचित करना चाहता हूँ कि उनमें में से एक बहुत बड़ा हिस्सा आपके राज्य से आता है। पिछले कुछ-एक सप्ताह में, कैंसर के 20 मरीजों में से 5 मरीज उत्तर प्रदेश के गौरवशाली राज्य से आए थे।

मुझे उनका परिचय देने दीजियेः

1) श्रीमान, यह उत्तर प्रदेश के जलगांव जिले के पास स्थित उरई से 28 साल के राजकमल प्रजापति हैं। वह गुटके और सिगरेट,दोनों की लत थी। उनकी जिंदगी की रक्षा करने के लिए कैंसर के फैलने को रोकने के लिए 28 अगस्त को उनकी जीभ का हिस्सा और उनके निचले जबड़े के अंदरूनी भागों को हटा दिया गया था।

2) जौनपुर के 47 साल के राकेश रंजन सिंह एक स्कूल अध्यापक और दो बच्चों के पिता हैं। उनके गाल पर कैंसर पाया गया था। आज वह एक अंगुली तक डालने के लिए अपना पर्याप्त मुँह नहीं खोल पाते हैं। इसलिए वह अपने मुँह को खोलने के लिए एक चम्मच और अंगुलियां इस्तेमाल करते हुए मिक्सर में पिसी हुई दूध-रोटी खाते हैं। चूंकि उनका कैंसर उन्नत चरण में है, सर्जरी शायद उनकी जिंदगी की रक्षा करने के लिए नाकाफी हो। उन्होंने हमें बताया है कि पान चबाने वाले उनके एक दोस्त का कुछ-एक महीने पहले बनारस में कैंसर का ऑपरेशन हुआ था।

3) उत्तर प्रदेश के बस्ती जिले के 51 साल के मोहम्मद अजाजूर रहमान लगातार कांपते रहते हैं। वह एक योग्य बिजली इंजीनियर हैं और नगरपालिका में काम करते हैं। मुँह और कैंसर में उन्नत चरण के कैंसर के बावजूद, जो साफ दिखाई देता है, उनका एक दिन में10 पहलवान छाप बीड़ी पीना लगातार जारी है, और इस लत को त्याग पाने में अपनेआपको बेबस पाते हैं।

4) 62 साल के सेवानिवृत्त मेजन जनार्दन लाल श्रीवास्तव, महाराजगंज जिले में लोक दल के जिला अध्यक्ष हैं। अगस्त, 2012 के मध्य में, जब उनकी आवाज काफी कर्कश हो गई तब उनके मुँह के पिछले हिस्से में कैंसरजन्य ट्यूमर पाया गया था। फिर भी उन्होंने आदतन 5-6 सिगरेट रोजाना पीना जारी रखा हुआ है।

5) 32 साल के दिनेश चंद शर्मा, उत्तर प्रदेश के मैनपुरी जिले में बवार से आए हैं। वे एक मोटरसाइकिल मैकेनिक और गैराज मालिक हैं, और खैनी - तम्बाकू और चूने का मिश्रण - खाने के शौकीन हैं। उन्होंने सिर्फ दो साल पहले ही इसको खाना शुरू किया था, और वो भी शाम को केवल 2-3 बार। दुर्भाग्यवश, खैनी खाना शुरू करने 8 महीने के बाद उनके गाल के अंदर एक ट्यूमर पैदा हो गया जहां वह तम्बाकू की चुटकी रखा करते थे। अब उनका कैंसर तेजी से उनकी जीभ में फैल रहा है और उन्हें साफ बोल पाने में बहुत कठिनाई हो रही है। उनकी जीभ को सर्जरी द्वारा हटाना एक विशिष्ट संभावना है जो डाक्टरों और सर्जनों की हमारी टीम के सामने खड़ी है।

महोदय, मेरे सहकर्मी और मैं आपका ऐसे अनेक मरीजों से परिचय करवा सकते हैं जो हरेक सप्ताह उत्तर प्रदेश से टाटा मैमोरियल अस्पताल में आते हैं। लेकिन मुझे उम्मीद है कि ये पांच काफी रहेंगे।

इस मामले की तात्कालिकता के प्रत्युत्तर में, हाल ही में केंद्र सरकार के स्वास्थ्य विभाग द्वारा जारी दिशानिर्देशों का पालन करते हुए 13 राज्यों ने गुटके और पान मसाला पर पाबन्दी लगा दी है। इन राज्यों में दिल्ली, मध्य प्रदेश, केरल, बिहार, महाराष्ट्र,हिमाचल प्रदेश, राजस्थान, हरियाणा, झारखंड, छत्तीसगढ़, गुजरात, मिजोरम और पंजाब, चंडीगढ़ संघशासित क्षेत्र शामिल हैं। निश्चित तौर पर वे सभी गलत नहीं हैं?

1 अगस्त, 2011 को स्वास्थ्य और परिवार कल्याण मंत्रालय (भारतीय खाद्य संरक्षा एवं मानदंड प्राधिकरण) द्वारा जारी अधिसूचना स्पष्ट है। इसमें कहा गया है, "उत्पाद में स्वास्थ्य के लिए हानिकारक कोई पदार्थ मौजूद नहीं होगाः तम्बाकू और निकोटीन को किसी भी खाद्य उत्पाद में संघटक के रूप में प्रयोग नहीं किया जाएगा।" इसलिए सभी धुआं मुक्त तम्बाकू उत्पाद जैसे गुटका, खैनी आदि अपनेआप वर्जित हैं। यह खाद्य संरक्षा और मानदंड अधिनियम, 2006, और भारतीय खाद्य संरक्षा एवं मानदंड प्राधिकरण, स्वास्थ्य मंत्रालय के प्राधिकार से है।

माननीय सर्वोच्च न्यायालय के समक्ष राष्ट्रीय स्वास्थ्य एवं परिवार कल्याण संस्थान (NIHFW) द्वारा प्रस्तुत रिपोर्ट में भ्रामक नाम"धुआं मुक्त तम्बाकू" से भारत में लाखों लोगों को होने वाली प्राणाघातक बीमारियों को प्रमाण दिया गया है। कृपयाhttp://tiny.cc/Report-NIHFW-SC पर इस रिपोर्ट को पढ़िये।

श्रीमान, आपके पास उत्तर प्रदेश में इस निषेधाज्ञा को लागू करने के लिए निर्विवाद शक्ति और जनादेश है। लेकिन मुझे यह देखकर दुख हो रहा है कि आपकी सरकार यह बहस करने में समय बर्बाद कर रही है कि क्या गुटका और पान मसाला को खाद्य पदार्थ कहा जा सकता है। गोदावत पान मसाला मुकदमे में, माननीय सर्वोच्च न्यायालय ने कहा था कि पान मसाला या गुटका खाद्य पदार्थ है। केरल, बिहार और अन्य राज्यों के माननीय उच्च न्यायालयों ने भी स्वतंत्र रूप से यह सही ठहराया है कि गुटका और पान मसाला"खाद्य पदार्थ" हैं जैसा कि इस अधिनियम के अंतर्गत परिभाषित है। निश्चित तौर पर विद्धान न्यायमूर्तिगण गलत नहीं हो सकते?

अगर उत्तर प्रदेश की सरकार अपने नागरिकों के बारे में इतनी कम परवाह करती हुई दिखाई देती है कि वह कानून के एक सुलझे हुए मामले पर अपने पैर घसीट रही है तो हमें बहुत दुख होगा।

अखिलेश जी, जिस दौरान आपके FDA आयुक्त और अन्य दफ्तरशाह काल्पनिक मसलों पर कानूनी बहस में उलझे हुए हैं, उस दौरान आपके राज्य में लोग मर रहे हैं। तम्बाकू उद्योग लाखों मासूम लोगों को अपना लतेड़ी बना रहा है, जिससे हजारों लोग सर्जरी के बाद पंगु और विकृत हो रहे हैं, और सैकड़ों मारे जा रहे हैं। गुजरने वाले हरेक महीने के साथ, जिंदगियां खत्म हो रही हैं और परिवार बर्बाद हो रहे हैं।

मदोहय, कृपया बिल्कुल विलंब नहीं कीजिये। गुटका और पान मसाला पर तुरंत पाबन्दी लगाइये।

Bombay HC heeds Voice of Victims, Upholds Ban on Pan-Masala along with Gutka

Mumbai, 15th September 2012: Many tobacco victims, and their anxious family members, will heave a big sigh of relief today. In a case that was keenly watched by public health activists and tobacco victims families, Bombay High Court today upheld Maharashtra's stringent ban on pan masala. The high court refused to give relief to eight big manufacturers of pan masala, gutka and allied products by issuing a stay order against the ban. Thus, the judiciary has vindicated the firm stand taken by Chief Minister Prithviraj Chavan and other leading administrators to curb the menace of tobacco.

Advocate General Darius Khambatta and Additional Solicitor General Kevic Setalwad defended the state government's decision to ban pan masala. Senior advocate Rajni Iyer represented the intervenor, namely Action Council against Tobacco India (ACT-India), which is an NGO based in Tata Memorial Hospital.

Harish Bakshi, a former victim who was part of the team that campaigned with the administration for this ban, hailed the court's decision and congratulated the Maharashtra government and civil society groups that had fought together for this issue. “I would particularly like thank FDA commissioner Mahesh Zagade, who took such a bold step. However, I am a bit worried by the fact that the administration is not destroying the stocks of gutka and pan masala seized, worth Rs 86 crores. Because it means they can be sold somewhere else.

“However, I heartily congratulate all the tobacco victims and surgeons from Tata Memorial hospital, who, supported by NGOs such as Salaam Bombay Foundation, had together campaigned for Maharashtra's stringent ban, which is miles ahead of other states. This stay order was being sought by the banned gutka industry in order to enable a backdoor re-entry for gutka, in the guise of independent tobacco pouches to be sold along with pan masala but intended to be consumed along with it. Getting pan masala excluded from the scope of this ban would have essentially nullified the ban. Indeed, as a former consumer, I know of prominent places such as outside CST station where tobacco and such products are being sold in independent pouches for mixing together. The police must crack down on such places and close the loopholes,” urges Harish.

Pan masala itself is not just an innocent mixture of arecanut cuttings, food flavours and sweeteners. It is a specialized product engineered for causing addiction, and as such, it is an ingenious mix of traditional items and chemicals such as magnesium carbonate., designed to deliver ever higher "highs" to addicts. The similarity in packaging and marketing of gutkha and pan masala is no accident; pan masala initiates unwary people and gets them to set foot on the slippery slope of addiction. Gutka, khaini etc. lie in wait further down that slope. Maharashtra FDA's ban order dated 19 July 2012 highlighted the risk posed by Magnesium Carbonate present in pan masala, which leads to hyper magnesia, and sometimes cardiac arrest. Even pan masala brands marketed as “tobacco-free” contain high levels of nicotine, as revealed by a study commissioned by the Ministry of Health. Laboratory analysis of randomly picked pan masala brand samples by the Central Tobacco Research Institute (CTRI), Rajahmundry, Andhra Pradesh has revealed that Rajnigandha pan masala contains 2.26 gm of nicotine per 100 gm of pan masala -- more than Goa 1000 Gutkha, a leading brand which has 2.04 gm of nicotine per 100 gm.

Among those who had eloquently made presentations to the Chief Minister, Deputy CM and sensitized the State Assembly was Sumitra Pednekar, wife of late Satish Pednekar, who had succumbed to oral cancer in 2011 at the age of 61 years. Satish Pednekar, a former Home and Labour Minister of Maharashtra, was fond of having 5 to 6 packets of gutka every day. This ban may have come too late for campaigners like Sumitra and her two daughters, who were emotionally and financially ruined by the death of Satish Pednekar. But if they are reading this, these campaigners may draw some comfort from the fact that their efforts were not in vain.

It refers to welcome DoPT advisory issued at instance of Prime Minister’s Office (PMO) directing all public-authorities under Central Government including even President Secretariat to put all details of tours and travels on respective websites, after public-authorities were flooded with RTI petitions seeking details of tours and travels at public-expense which even accounted for as much as of half the budget meant for PMO and council of ministers.

Making such aspects public will tend to make a self-imposed check by concerned ones to avoid misuse like was done by none other than former President of India Pratibha Patil when despite bitter-most criticism for already having spent rupees 205 crores, she went ahead with another such trip to South Africa etc in last days of her tenure cancelling earlier-fixed engagements just for a ferry-trip for her grand-children. There should be a total ban on taking relations and friends on official trips other than spouse even by President of India. However another lady family-member may accompany dignitaries like President and Prime Minister in requirement of protocol in case wife of any such dignitary may not be able to accompany.

Study should be made for other common queries put through RTI petitions, and all such commonly queried aspects should also be directed to be put on websites. All public-authorities should be directed to follow practice of Railway Ministry to put scanned copies of all RTI petitions and responses on websites.

Maharashtra RTI Rules Amendment – The Process began in 2009, unknown to Civil Society

2 July 2012, Mumbai:  RTI activists of other states should take a lesson from the experience of Maharashtra RTI activists, and be very alert. Maybe they should all file RTI applications to their Law and Judiciary department and General Administration Department to find out what is going on. Because, by reading the documents procured under RTI from General Administration Department by RTI activist G R Vora (            9869195785      ,grvora1@gmail.com), we are surprised to find that the process of amendment was quietly going on for the past 2-3 years, unknown to all of us. The community of RTI activists and users of Maharashtra felt betrayed that the state government had not taken us into confidence by holding a public consultation. They reacted very strongly. Some activists have challenged this amendment in Bombay High Court.

We requests our fellow activists – especially those who are comfortable analyzing Marathi documents – to study these documents and share their understanding with all of us on internet. Quite probably, there will be lessons in it for RTI activists from all states on how to be more watchful, and not get taken by surprise in future.

SEVEN USEFUL THINGS:

1)      THE LIST OF 97 REGISTERS MAINTAINED BY MUMBAI POLICE COMMISSIONER’S OFFICE on page 10-12 is very useful. RTI activists can simply ask for copy of pages of a particular register between two cut-off dates e.g. 1 Jan 2009 to 31 Dec 2011. Or they can ask for inspection of particular registers.

2)      PERIOD OF PRESERVATION OF EACH REGISTER on page 13 makes it easy to file RTI applications and reduce chances of arbitrary denial.

3)      POWERS & DUTIES of Mumbai Police Officers & Employees are explained from page 4 to 9.

4)      ORGANIZATIONAL CHART on page 3 makes the Mumbai police hierarchy clear to laymen.

5)      VARIOUS OFFICERS’ PHONE AND FAX numbers are given page 16 onwards.

6)      VISITING HOURS for citizens etc. are specified on page 88.

7)      PIOS, APIOS & FIRST APPELLATE AUTHORITIES’ phone numbers and addresses are given page 89 onwards.

[Note: I selected the email ids of 10 Mumbai police officers from this list. Four of the addresses bounced my message i.e. my emails were hopefully delivered to six email ids. Hope the cops are checking these email addresses, because many still prefer to use yahoo and gmail for official purposes!]

The Maharashtra Police website also appears to have some other useful features e.g. tracking the progress of a missing person complaint, etc. But do these features actually work? Someone will have to test it and see.
